Democrats are targeting Missouri Republican Senator Josh Hawley, along with Ted Cruz, for expulsion or censure. Their case rests on trying to link Cruz and Hawley and their legitimate questions on election integrity with the assault on the Capitol. Democrats filed an ethics complaint on this last week, even though neither Senator has ever said one word in support of the Capitol attack. Hawley even said this on overturning the election result prior to the attack.

“I think there’s no votes for that, I mean, at all,” Hawley told media, stating he wanted a full debate on election irregularities. So Hawley, not being a man to take injustice lightly, filed his own ethics complaint against the seven Democrats on Monday.

He wrote his election results objection was “a lawful process” invoked used by Democrats and that “my objection rested on far more solid ground than the electoral college objections submitted by Democrat Members of Congress after the 2000, 2004 and 2016 elections…[b]y knowingly submitting a frivolous complaint to accomplish impermissible partisan purposes, these Senators have engaged in improper conduct that may reflect upon the Senate. The Committee should discipline these Members to ensure that the Senate’s ethics process is not weaponized for rank partisan purposes.”

Politico: “Hawley’s counter-complaint comes after Sen. Sheldon Whitehouse (D-R.I.) — joined by Sens. Tim Kaine (D-Va.), Ron Wyden (D-Ore.), Tina Smith (D-Minn.), Richard Blumenthal (D-Conn.), Mazie Hirono (D-Hawaii) and Sherrod Brown (D-Ohio.) — wrote to the Ethics committee last Thursday requesting an investigation of Hawley and Cruz (R-Texas), who led Republican efforts in the Senate to challenge President Joe Biden’s Electoral College victory. It was during Congress’ certification of Biden’s win that a mob of pro-Trump rioters stormed the Capitol, breaching the building’s walls and temporarily halting the proceedings. Lawmakers were forced to shelter-in-place as both chambers went into lockdown, and at least five people died as a result of the violence — including a Capitol police officer.”

The Democrats wrote that “[b]y continuing to object to the electors after the insurrection, Senators Cruz and Hawley lent legitimacy to the mob’s cause.” Absolute rubbish. But the assault on the Capitol is now a carte blanche excuse to rationalize any Democrat move.

“The idea that one Senator who disagrees with another Senator can therefore have that Senator punished, sanctioned, censured, or removed is utterly antithetical to our democracy and the very idea of open, lawful debate,” Hawley wrote in a letter to the seven Democrats.

“In light of the shameful abuse of the ethics process you have deliberately engaged in, I have considered whether I should call for you to resign or be expelled from the Senate. But I continue to believe in the First Amendment, which the US Supreme Court has repeatedly said protects even ‘offensive’ and malicious speech, such as yours.”
