Hennepin County Attorney Mary Moriarty will not pursue criminal charges against a staffer in Governor Tim Walz’s administration who was caught on camera vandalizing multiple Teslas in Minneapolis, despite damage estimates exceeding $20,000 and at least six victims identified.

Instead, Moriarty’s office announced it will pursue a “pre-charge diversion” program for the suspect, Dylan Bryan Adams, 33, who works as a fiscal policy analyst for Governor Walz.

Adams was seen on surveillance video keying a Tesla while walking his dog.

He was arrested last week in connection with the incidents.

The Hennepin County Attorney’s Office defended its decision in a statement provided to Fox 9, saying the approach is meant to ensure accountability while avoiding criminal prosecution.

“Our main priorities are to secure restitution for the victims and hold Mr. Adams accountable,” said Daniel Borgertpoepping, spokesperson for the Hennepin County Attorney’s Office.

“As a result, we will file for pre-charge diversion to best facilitate both of those goals. This is an approach taken in many property crime cases and helps to ensure the individual keeps their job and can pay restitution, as well as reducing the likelihood of repeat offenses. Criminal prosecution remains a possibility should unlawful behavior continue.”

The diversion program means Adams will likely avoid a criminal record if he completes certain conditions set by prosecutors, including repaying the victims and potentially undergoing counseling or community service.

Critics argue that this decision allows politically connected individuals to avoid accountability.

The Minneapolis Police Department issued a statement expressing frustration with the county attorney’s handling of the case.

“The Minneapolis Police Department did its job,” the department said in a statement to Fox 9.

“It identified and investigated a crime trend, identified and arrested a suspect, and presented a case file to the Hennepin County Attorney Office for consideration of charges. This case impacted at least six different victims and totaled over $20,000 in damages. Any frustration related to the charging decision of the Hennepin County Attorney should be directed solely at her office.”

The statement continued, “Our investigators are always frustrated when the cases they poured their hearts into are declined. In my experience, the victims in these cases often feel the same.”

Adams, who works in state government under Governor Tim Walz, has not publicly responded to the incident.

Governor Walz, who ran unsuccessfully for vice president, has not commented on the case either.

Mary Moriarty, a former public defender, was elected as Hennepin County Attorney in 2022 with significant financial backing from political action committees supported by billionaire George Soros.

Soros-linked organizations have contributed heavily to district attorney races nationwide, often backing candidates who favor progressive criminal justice reforms and alternatives to traditional prosecution.

This case has drawn attention due to the political connections involved and the decision to forego criminal charges in a case with multiple victims and documented property damage.

A hearing date has not been set, and it remains unclear whether Adams will face further legal consequences if additional information emerges or conditions of the diversion program are not met.
